A traffic violation, or a traffic infraction, is the least serious traffic offense. This violation is an act or omission that is prohibited by the law but is not considered a crime.
Some of the most common infractions are speeding, failing to stop, failing to signal, or seat belt violations.5
A traffic offense is a more serious incident when compared to a traffic infraction. This type of offense is considered a misdemeanor or felony and is punishable by imprisonment.
Common traffic offenses include driving under the influence, driving on a suspended license, reckless driving, or vehicular homicide. The individual’s crime is determined to be either a misdemeanor or felony based on the outcome (i.e., injury to another person), level of the crime, or repeat offenders.
A non-traffic infraction is issued by state or local law enforcement agencies for various offenses that typically have to do with equipment, the car itself, or non-moving violations, such as illegal parking, littering, or faulty headlights/tail lights.6
In most states, non-traffic violations are considered fine-only offenses and do not accrue points on a person’s record.7

However,a judge may dismiss a secondary parking ticket if the car was parked in the same location as the original violation. Secondly, a judge may consider dismissing the second parking ticket for the same “status” of violation as the original parking ticket.14
